National Probate Services (“NPS”, “we”, “us”, “our”) is an online directory and lead-delivery service operated by Talos AI LLC, a Wyoming limited liability company. These Terms of Service (“Terms”) govern your access to and use of the website at nationalprobateservices.com and any related services (collectively, the “Service”).
By creating an account, claiming a listing, subscribing to a paid plan, or otherwise using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract. If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Accounts
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@nationalprobateservices.com if you suspect unauthorized access. We are not liable for losses arising from compromised credentials you failed to secure.
3. Vendor Listings
NPS publishes a directory of probate-adjacent service providers (attorneys, estate movers, auctioneers, liquidators, real estate agents, appraisers, care managers, and related professionals). You may submit a listing for your business subject to our submission guidelines. We reserve the right to edit, decline, or remove any listing at our sole discretion.
You represent that all information you submit about your business is accurate, that you have authority to represent the business, and that the business is properly licensed where required by law.
4. Listing Claims
If we have already published a listing about your business based on publicly available information, you may claim that listing through our verification process (email-from-domain match, DNS verification, or manual review). Successful claim transfers control of the listing to you, but does not alter the historical content unless you request changes.
5. Lead Subscriptions (Paid)
NPS offers paid subscription plans that deliver matched probate leads to your vendor account. By subscribing, you agree to:
- Pay the monthly fee for your chosen plan in advance via your designated payment method.
- Recurring auto-renewal unless you cancel before the next billing cycle.
- Use leads only for legitimate professional outreach in your service area; not resell, transfer, or distribute them to third parties.
- Honor all applicable laws regulating professional outreach including the TCPA, CAN-SPAM Act, and state-level consumer protection statutes.
6. Lead Data — Accuracy and Use
Lead records are aggregated from public probate court filings and may contain errors, omissions, or stale information. We make no warranty as to the accuracy, completeness, or currency of any individual lead. You use leads at your own risk and assume all responsibility for compliance with applicable law when contacting leads.
7. Prohibited Conduct
You may not:
- Use the Service to harass, defraud, or deceive any person, including leads or other vendors.
- Scrape, mirror, or systematically extract data from the Service without our prior written permission.
- Submit false, misleading, or fraudulent information.
- Interfere with the operation of the Service or attempt to bypass security measures.
- Use the Service to violate any applicable law or regulation, including state bar rules if you are an attorney.
8. Intellectual Property
The Service, including all content, software, design, trademarks, and trade dress, is owned by Talos AI LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
9. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any specific lead will result in business outcomes.
11. Limitation of Liability
To the fullest extent permitted by law, our aggregate liability arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. We are not liable for any indirect, incidental, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold Talos AI LLC and its officers, employees, and agents harmless from any claim arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms shall be resolved exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of such courts.
14. Dispute Resolution
Before initiating any formal action, you agree to first contact us at support@nationalprobateservices.com and attempt to resolve the dispute informally for at least thirty (30) days.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email to your account address and posted with a new “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance.
