Richard A. Fogel
New Jersey, New York, 2nd Circuit, U.S. Supreme Court
I am a Litigation Attorney that concentrates my practice on Insurance Coverage, Toxic Torts, Environmental, Product Liability & Commercial Litigation. In particular, I represent landlords, small businesses such as manufacturers, distributors, retailers, waste haulers and dry cleaners, and I defend insured businesses for insurance companies. For more than two decades I have defended litigation claims involving lead paint, mold, asbestos, benzene, ink, and other toxic tort and environmental claims as well as related insurance coverage disputes and disputes between insurance companies. I routinely litigate commercial and contractual claims as well as shareholder and partnership disputes for small businesses and I was outside general counsel for a retailer. I have a Master’s Degree in Environmental Science so I have a unique ability to work with technical experts on scientific issues and communicate complex causation and technical explanations to courts and juries. My practice is ninety percent repeat business because my focus is on getting the matter resolved on a cost effective basis that serves the client’s best interests. This is not a volume practice unlike many insurance defense firms. My practice is designed for personal service for technical cases without incurring the premium price demanded by larger firms. I have been practicing since 1987 and have been a partner at large firms. In 2004, I decided to open my own boutique to better serve my longstanding clients and control my overhead so my rates remain very competitive. I appear in all courts located in the greater New York area and northern New Jersey. Job One at my firm is to resolve litigation cost effectively. I am a “Bests Recommended Insurance Counsel”, rated “AV” for ethical standards and legal ability by LexisNexis/Martindale Hubbell and a nominated member of the Claims and Litigation Management Alliance. I teach business law and litigation as an adjunct professor at Nassau Community College.
